RBI Amends Capital Adequacy Norms for Multiple Bank Categories

In a series of coordinated amendments issued on October 7, 2026, the Reserve Bank of India updated the capital adequacy frameworks for various categories of banks and financial institutions. The changes cover Commercial Banks, Small Finance Banks, Payments Banks, and All India Financial Institutions (AIFIs), reflecting a comprehensive approach to prudential regulation.

The amendments modify existing Directions—including the Reserve Bank (Commercial Banks – Prudential Norms on Capital Adequacy) Directions, 2025—to align India's regulatory regime with Basel III and other international standards. Notably, paragraph 85(6)(i) for Commercial Banks, paragraph 75(5)(i) for Small Finance Banks, paragraph 52(5)(i) for Payments Banks, and paragraph 77(6)(i) for AIFIs have been revised. These previously mandated that clearing member banks or financial institutions obtain a legal opinion for certain exposures. The RBI, upon review, has decided to relax this requirement in specific cases to reduce compliance burden without compromising risk oversight.

Further, the Twelfth Amendment Directions, 2026 for Commercial Banks also address valuation adjustments for incurred but not reported (IBNR) losses, enhancing forward-looking risk provisioning. Similarly, the Third and Sixth Amendment Directions for Payments Banks and Small Finance Banks streamline reporting formats and capital composition rules.

"On a review, it has been decided to amend these Directions to align them with international best practices and reduce unnecessary compliance burden,"
the notifications state, indicating a maturing regulatory philosophy that balances safety with efficiency.

Legal practitioners must note the cumulative effect of these amendments when advising banks on capital planning, audit preparedness, and regulatory reporting. The harmonisation across bank categories simplifies multi-client advisory but demands updated due diligence checklists. These changes underscore the RBI's commitment to a coherent, risk-sensitive prudential architecture.
