The bench, comprising Justices Manmohan and Manoj Misra, emphasized recognition of the individuality and agency of adults in forming relationships.

The court noted that not all relationships will culminate in marriage and that it is inappropriate to consider the conclusion of a relationship as infidelity or moral failure. Such presumptions, the court stated, can lead to unjust social stigma against individuals.

“Physical relationship between two consenting unmarried adults cannot be stigmatized as a mark against character,” the court opined.
