SC Grants Bail to Sanjay Sureka in Concast Steel Case

Supreme Court grants bail to Sanjay Sureka in PMLA case; five-day delay in Section 19(2) ED confirmation does not vitiate arrest.

Supreme Court Grants Bail in Concast Steel PMLA Case

The Supreme Court has granted bail to Sanjay Sureka, a key accused in the money laundering case linked to the collapse of Concast Steel, after prolonged custody. While scrutinizing the arrest procedure, the Court held that a five-day delay in the Enforcement Directorate’s (ED) confirmation of arrest under Section 19(2) of the PMLA did not invalidate the detention.

The defense had challenged the legality of the arrest, arguing non-compliance with the mandatory requirement to file a confirming memo within three days. The Court, however, observed that procedural delays, while undesirable, do not automatically render an arrest illegal if the overall investigation remains fair and the rights of the accused are protected.

"Technical non-compliance, absent prejudice to liberty or fairness, will not ipso facto nullify prosecution."

This judgment clarifies the judiciary’s stance on procedural lapses in PMLA arrests. For practitioners, it reinforces that challenges to custody must focus on substantial prejudice rather than mere delay. The bail order may signal judicial caution in extending pre-trial detention in high-profile PMLA cases absent flight or tampering risks.
