Parliament Can Extend BOCW Cess to J&K: HC

October 1, 2026

J&K HC upholds Parliament’s power to extend Building and Other Construction Workers Cess Act to J&K; applies to post-2007 contracts.

BOCW Cess Applies to J&K: High Court Rules

The Jammu & Kashmir High Court upheld the constitutional competence of Parliament to extend the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Cess Act, 1976, to the Union Territory of Jammu & Kashmir.

The tribunal ruled that cess liability applies to contracts issued by National Industrial Tribunal (NIT)-constituted entities after July 31, 2007—the date of the Welfare Board’s constitution. The judgment reinforces the financial obligations of contractors in the region.

Implications for Practitioners

Corporate and construction firms operating in J&K must factor in BOCW cess liabilities for applicable contracts. Legal teams should conduct due diligence on subcontractor compliance and ensure timely cess deposits to avoid enforcement actions.
