NCLT Initiates CIRP Against Eros International Media

The National Company Law Tribunal (NCLT) has admitted a plea under Section 9 of the Insolvency and Bankruptcy Code (IBC) against Eros International Media for its failure to clear revenue payments related to the film NH-10. The tribunal determined that the acknowledged default by Eros constituted an operational debt, necessitating the initiation of the Corporate Insolvency Resolution Process (CIRP).

The NCLT's ruling is anchored in the concept of operational debt, which refers to any liability arising from the supply of goods and services. In this case, the payment due for film revenue was deemed an operational obligation that had not been fulfilled by Eros International. The acknowledgment of default permits the operational creditor to file for insolvency proceedings.

This decision emphasizes the increasing willingness of the NCLT to intervene in matters where operational debts remain unpaid, signaling a robust approach towards protecting the rights of creditors. With the initiation of CIRP, Eros International Media will undergo a structured insolvency process aimed at resolving its financial distress.

The tribunal held that Eros’s acknowledged default constituted an operational debt, warranting initiation of the Corporate Insolvency Resolution Process (CIRP).

For legal practitioners, this ruling reinforces the legal precedent that operational debts can trigger insolvency proceedings, allowing creditors to seek an effective remedy for unpaid dues. It underlines the importance of compliant financial practices within the entertainment industry and beyond.
