Insufficient Grounds for Disputing Insolvency Admission

The National Company Law Appellate Tribunal (NCLAT) ruled that pre-existing disputes related to supply delays and defects do not hinder the admission of insolvency for operational debts that are undisputed. This decision reinforces the principles of the Insolvency and Bankruptcy Code (IBC) in handling operational debts.

The appellate tribunal articulated that operational debts, once admitted, must be addressed accordingly, regardless of any claims of defective supplies or delays. By doing so, the NCLAT condemned attempts to mask undisputed debts through illusory disputes over supply-related issues, thereby emphasizing the integrity of insolvency proceedings.

The NCLAT observed, "Operational debt that is undisputed remains a valid ground for the admission of insolvency, irrespective of underlying disputes regarding the supply of goods."
