NCLAT to Hear Subhash Chandra's Appeal Tomorrow Over Liability Reduction

August 31, 2026

Subhash Chandra has appealed against a recent NCLT decision reducing his liability from ₹22,000 crore to ₹6.25 crore. Creditors are expressing strong discontent, claiming the ruling significantly undermines their recovery prospects.

NCLAT to Review Subhash Chandra's Liability Appeal

The National Company Law Appellate Tribunal (NCLAT) is set to hear an appeal filed by Essel Group founder Subhash Chandra against the National Company Law Tribunal's (NCLT) recent ruling. The NCLT had drastically reduced Chandra's liability from ₹22,000 crore to just ₹6.25 crore, a verdict that has drawn considerable criticism from various creditors.

During today's proceedings, Solicitor General (SG) Tushar Mehta, representing a creditor, urged for an urgent listing of the case, articulating the significant financial implications the NCLT's order holds for the creditors involved. The judgment has raised serious concerns given that affected creditors are expected to recover only around 0.028% of their original claims.

The contentious decision by the NCLT has prompted an uproar among the stakeholders and creditors, who feel that the ruling discriminates against them, potentially affecting their rights to equitable recovery. Legal experts anticipate that the NCLAT's decision could have major ramifications for insolvency proceedings involving high-profile individuals.

As practitioners await the NCLAT’s ruling, this case highlights the ongoing tensions in insolvency laws concerning the balance of interests between debtors and creditors. The outcome could set a precedent for future cases involving significant liability disputes.
