Calcutta HC directs correction of 17 EDI shipping bills from 'N' to 'Y' reward flag and processing of MEIS benefits by 31 Dec 2026 due to inadvertent error.
Calcutta HC Restores MEIS Benefit Despite EDI Error
The Calcutta High Court ruled that an inadvertent marking of the reward flag as ‘N’ instead of ‘Y’ in 17 EDI shipping bills does not disentitle exporters to the Merchandise Exports from India Scheme (MEIS) benefit. The Court directed Customs and the Directorate General of Foreign Trade (DGFT) to correct the flags and process claims by 31 December 2026.
The Court emphasized that procedural irregularities of a technical nature must not defeat substantive rights, especially where export obligations were fully met. It invoked equitable principles to prevent unjust enrichment of the revenue at the expense of compliant exporters.
Practitioner Takeaway: Minor technical errors in electronic submissions may be rectified if exporters demonstrate due compliance with core export conditions. Timely judicial intervention can preserve legitimate duty benefits.
