Madras High Court quashed a GST assessment demanding more than the show cause notice, mandating fresh proceedings for any enhanced demand.
Madras HC Caps GST Demand to SCN Limits
The Madras High Court set aside a GST assessment order where the final tax demand exceeded the amount specified in the initial show cause notice (SCN). The Court ruled that any increase in demand beyond the SCN requires issuance of a fresh notice, citing violation of principles of natural justice if omitted.
The department had assessed a taxpayer for 100% of unpaid tax after allowing 50% payment as per settlement provisions, then proceeded to cancel registration due to remaining dues. The Court held that such action is disproportionate and observed
the power to cancel registration cannot be mechanically invoked without considering the taxpayer’s compliance history and representation.
The judgment reinforces procedural fairness in GST assessments. Assessing officers must now ensure that all potential demands are included in the SCN or issue a fresh notice if new grounds emerge. Taxpayers should challenge any ex parte enhancement not preceded by proper notice.
