ITAT Weekly Roundup: 11–17 October 2026

The Income Tax Appellate Tribunal (ITAT) issued several important orders between 11 and 17 October 2026, clarifying key issues relating to deductions, TDS compliance, and business expenditure. These rulings collectively reinforce the importance of documentary compliance and the application of judicial principles in factual assessments.

One of the notable decisions during this period involved a commission agent’s claim of adat expenses amounting to Rs. 1.66 crore, which had been added back by the Assessing Officer for lack of evidence. The ITAT examined the nature of adat transactions — informal credit arrangements common in certain business communities — and assessed whether deductions could be allowed despite minimal documentation.

The ITAT ruled in favour of the assessee, noting that TDS had been duly deducted and deposited on the payments. The Tribunal emphasized that compliance with TDS obligations under Section 194C of the Income Tax Act, 1961, coupled with bank-trail evidence, substantiated the genuineness of the expenses. It held that disallowance solely for non-maintenance of detailed records, despite TDS compliance, was unjustified.

"Mere absence of detailed books of account cannot override the existence of bank trail and TDS compliance, which collectively establish the reality of the transaction,"

the Tribunal observed. This ruling sets a precedent for cases involving informal credit arrangements, where the presence of TDS and banking channels plays a pivotal role in validating claims. Tax practitioners should leverage this decision when defending similar additions, especially in sectors reliant on adat or hundi-based credit systems.
