ITAT Quashes Rs. 1.66 Cr Addition on Commission Agent’s Expenses

The Income Tax Appellate Tribunal (ITAT) has deleted an addition of Rs. 1.66 crore made by the Assessing Officer on account of disallowed adat (advance) expenses incurred by a commission agent. The Tribunal held that the expenditures were genuine, supported by documentary evidence, and that Tax Deducted at Source (TDS) had been duly deposited under Section 194H.

The AO had disallowed the expenses on grounds of lack of verification and suspected circular transactions. However, the ITAT observed that the assessee had produced bank statements, commission agreements, and TDS challans, establishing the authenticity of payments.

"Mere non-tracing of ultimate recipients does not invalidate expenditure where TDS is complied with and primary records are available,"
the Tribunal ruled.

This decision reinforces the importance of procedural compliance, particularly TDS, in substantiating business expenses. For tax practitioners, it underscores that while scrutiny of adat transactions remains high, compliance with withholding tax obligations and maintenance of contemporaneous records can successfully rebut allegations of bogus expense claims.
