ITAT Deletes Rs. 1.66 Crore Addition in Commission Agent's Case

The Income Tax Appellate Tribunal (ITAT) has deleted an income addition of Rs. 1.66 crore made by the Assessing Officer (AO) against a commission agent on grounds of allegedly excessive adat (commission advance) expenses. The AO had disallowed these expenses under Section 40A(2) of the Income Tax Act, 1961, arguing they were disproportionate to the fair market value of services rendered.

The tribunal observed that the appellant had fully complied with TDS provisions under Section 194H, deducting tax on the entire commission amount paid. The assessee provided detailed account statements, commission agreements, and TDS certificates to substantiate the transactions.

"Mere assertion of disproportionality without independent evidence of undue advantage or lack of business expediency is insufficient to justify disallowance,"
the ITAT held, relying on precedents including Britannia Industries Ltd. v. ACIT.

The ruling emphasizes that compliance with TDS obligations and proper documentation create a rebuttable presumption of genuineness under Section 40A(2). For practitioners, this reinforces the need to assess substance over form objections only when supported by cogent evidence, particularly in cases involving standard commission arrangements.
