The Income Tax Appellate Tribunal (ITAT) deleted a Rs. 1.66 crore addition made on alleged adat expenses of a commission agent, holding that the assessee had complied with TDS provisions under Section 194H, thus validating the legitimacy of the expenditure.
In a significant ruling for commission agents and income tax practitioners, the Income Tax Appellate Tribunal (ITAT) deleted an addition of Rs. 1.66 crore made by the Assessing Officer on the grounds of adat (unaccounted) expenses, observing that the assessee had duly complied with tax deduction at source (TDS) obligations under Section 194H of the Income Tax Act, 1961.
The dispute arose when the revenue authorities questioned payments made by the commission agent to various sub-agents, treating them as unexplained expenditures under Section 69 of the Act. However, the ITAT noted that the assessee had issued proper TDS certificates (Form 16A) and filed quarterly TDS returns under Section 194H, which pertains to commission or brokerage exceeding Rs. 15,000 in a financial year. The tribunal emphasized that such compliance creates a legal presumption of the genuineness of the transactions, unless the department demonstrates evidence of collusion or sham arrangements.
The fact that TDS has been duly deducted and deposited under Section 194H strongly supports the authenticity of the payments, and without material evidence to suggest fictitiousness, the addition cannot be sustained.
The tribunal also observed that the books of accounts were regularly maintained, and bank statements corroborated the transaction trail. Mere absence of concurrent verification of sub-agents’ records does not render the expenditure liable to addition if primary compliance is fulfilled.
This decision reinforces the evidentiary value of TDS compliance in defending business expenditures, especially in sectors reliant on decentralized agent networks. Practitioners should ensure meticulous TDS documentation to counter scrutiny under unexplained transactions’ provisions.
