ITAT Deletes ₹1.66 Crore Addition for Commission Agent's Adat Expenses
The Income Tax Appellate Tribunal (ITAT) has deleted an addition of ₹1.66 crore made by the Assessing Officer on alleged adat expenses incurred by a commission agent, holding that the payment was legitimate and duly supported by TDS compliance under Section 194H of the Income Tax Act, 1961.
The tribunal observed that the appellant, engaged as a commission agent, had made payments to various sub-agents, which were characterized as adat expenses. The revenue had challenged the genuineness of these payments, alleging lack of documentation and possibility of bogus claims. However, the ITAT noted that TDS had been deducted and deposited under Section 194H on the amounts paid, and Form 16As were issued, which corroborated the transaction trail.
"The deduction of TDS and issuance of Form 16A lend credibility to the claim of actual payment. Absent any material showing collusion or sham transactions, the expenditure cannot be rejected solely on suspicion,"the tribunal held. It emphasized that the burden shifts to the department once the taxpayer demonstrates TDS compliance and furnishes supporting bank statements.
The ruling reinforces the evidentiary weight of TDS compliance in validating business expenditures, particularly in commission-based structures. Practitioners should ensure that taxpayers maintain complete TDS records and payment trails to substantiate such claims during assessments.
