ITAT: AO Not Investigator but Passive Recipient of Info

October 25, 2026

The ITAT held that an Assessing Officer is not an investigator but a passive recipient of information, and cannot initiate proceedings solely based on unverified third-party data.

ITAT Clarifies Role of Assessing Officer in Probe

The Income Tax Appellate Tribunal observed that the Assessing Officer (AO) functions as a passive recipient of information rather than an investigator, and cannot initiate proceedings under Section 147 merely on the basis of uncorroborated or unverified data received from third parties.

The Tribunal stressed that reopening an assessment requires a tangible basis linking the new information to unexplained income or a failure to disclose material facts. If an order is found prejudicial with respect to even a single item, the validity of reopening may be challenged. The AO is not justified in treating all unexplained credits as income simply because they are unverified.

"The AO cannot act as a detective but must assess the material objectively and fairly."

This decision provides a check against arbitrary or mechanically initiated reassessments. Practitioners should invoke this principle when defending against notices based on data dumps or mismatch alerts lacking specific incriminating content.
