ICAI Suspends CA for Failing to Report ₹1,150cr Fraud

The Institute of Chartered Accountants of India (ICAI) has removed a chartered accountant's name from the register for one year for professional misconduct arising from audit lapses in a case involving the siphoning of ₹1,150 crore. The failure to evaluate going concern uncertainties and report material financial irregularities formed the core of the disciplinary action.

The disciplinary committee found that the auditor did not exercise due professional care under the Standards on Auditing (SA) and violated multiple clauses of the Chartered Accountants Act, 1949. Specifically, the CA failed to raise red flags on inter-corporate transactions lacking commercial substance and did not assess the entity’s ability to continue as a going concern despite mounting liabilities.

The order stresses auditors’ duty to report fraud under Section 143(12) of the Companies Act, 2013. The CA’s inaction, in the face of clear financial distress indicators, amounted to gross negligence. The suspension serves as a warning to statutory auditors regarding heightened accountability in fraud detection and risk disclosure.

Practitioners must ensure rigorous documentation and escalation of material irregularities during audits. This decision reinforces ICAI’s stance on audit quality and may lead to stricter enforcement actions against professionals overlooking red flags in financial reporting.
