Gujarat HC Upholds Judge's Removal for Benami Assets

October 2, 2026

Gujarat High Court upholds dismissal of Judicial Magistrate over unexplained benami mobile phones and failure to disclose vehicle purchases and loan, affirming judicial integrity standards.

Judicial Accountability: Gujarat HC Upholds Magistrate’s Dismissal

The Gujarat High Court has upheld the dismissal of Judicial Magistrate First Class (JMFC) Amratlal Narendrabhai Vizoda from service for serious misconduct, including possession of three benami mobile phones and failure to disclose personal vehicle purchases and a loan. In Amratlal Narendrabhai Vizoda v. State of Gujarat & Anr, a Division Bench of Justices NS Sanjay Gowda and JL Odedra endorsed the state’s disciplinary action as justified and proportionate.

The Court found that one of the mobile phones was registered under a pseudonym and used for undisclosed communications, thereby raising concerns about abuse of office and potential obstruction of justice. The failure to file mandatory asset disclosures under the Judicial Officers (Code of Conduct) Rules violated institutional accountability standards. The ruling stressed that judicial officers must adhere to higher ethical benchmarks than other public servants, given their role as custodians of justice.

The judgment serves as a cautionary reminder that procedural irregularities in financial disclosures can lead to severe consequences, especially in judicial appointments. Practitioners representing public officials in disciplinary proceedings must ensure strict compliance with transparency norms. Courts are increasingly unwilling to overlook omissions in asset declarations, particularly where they suggest deliberate concealment.
