Gujarat High Court quashes reopening of assessment based on misreading of audit findings, calling it mere change of opinion.
Gujarat HC: Reassessment Invalid on Misread Audit Report
The Gujarat High Court has struck down the reopening of an income tax assessment, holding that relying on a misreading of the audit report does not constitute tangible material to justify reassessment under Section 147 of the Income Tax Act, 1961.
The court reiterated that reopening is impermissible based on a “change of opinion” rather than fresh evidence indicating escapement of income.
"Mere difference in interpretation or erroneous application of law by the AO cannot be grounds for reassessment,"the bench ruled.
This decision strengthens safeguards against arbitrary re-openings. Tax professionals should ensure that notices under Section 148 are challenged when based solely on reinterpretation of existing records, without new material.
