The ruling arose from allegations that the petitioners had violated money lending laws in the context of unresolved financial disputes within a business partnership. The court found that speculative claims based solely on ITR discrepancies lacked adequate foundation to uphold criminal proceedings.

By granting bail, the court acknowledged the necessity of protecting individuals from unwarranted criminal liabilities stemming from partnership disputes, emphasizing that misunderstandings regarding financial accounts should not expediently lead to severe criminal accusations.

“The claims were under a partnership dispute relating to accounts which were earlier blocked by the police,” the court noted.
