GST Council Enforces Zero Tolerance for Fake ITC Fraud

October 9, 2026

The GST Council announced zero tolerance for fake ITC fraudsters using AI-driven, high-risk profiling tools to detect and prevent fraudulent claims.

AI-Driven Crackdown on Fake ITC Fraudsters

The GST Council has declared zero tolerance for fake input tax credit (ITC) fraud, introducing AI-powered, high-risk profiling tools to proactively identify suspicious filings and fraudulent registrations. The move targets 'ghost' dealers and circular fake billing networks that exploit the GST system.

The AI tools will analyze transaction patterns, supplier-recipient discrepancies, and invoice-level anomalies to flag high-risk taxpayers for immediate investigation. The department will also intensify actions under Section 132 (criminal prosecution) against repeat offenders and entities involved in large-scale fraud.

Legal practitioners must now conduct enhanced due diligence when advising clients on vendor onboarding and ITC availing. Proactive compliance audits and documentation standards will be critical to avoid being caught in departmental dragnets triggered by algorithmic detection systems.
