Patna HC upheld validity of departmental circulars assigning proper officers under GST; refused to interfere with Section 74 proceedings.
GST Circulars Assigning Proper Officers Upheld: Patna HC
The Patna High Court upheld the validity of circulars issued by GST authorities to assign jurisdictional proper officers. It declined to interfere with a demand notice issued under Section 74, observing that such administrative circulars are within rule-making competence and serve operational efficiency.
The petitioner had challenged the circulars as arbitrary, arguing they bypassed formal notification. However, the Court ruled that where circulars are issued under delegated powers and clarify procedural assignments without substantive law changes, they are legally sustainable.
Circulars that facilitate administrative assignments, especially of proper officers under Section 7(2) and 11(2), are valid so long as they do not override statutory provisions or create new obligations.
This decision affirms the department’s authority to issue operational guidance. Practitioners must now treat such circulars as binding unless specifically challenged by legislative override.
