Delhi HC on ZARA v. ZORA: No Formal Declaration Needed for Section 11(2)

September 30, 2026

The Delhi High Court ruled that a formal declaration under Rule 124 is not mandatory to invoke Section 11(2) of the Trade Marks Act, 1999, affirming that well-known trademark status can be established through evidence in individual proceedings.

Delhi High Court Rules on Well-Known Mark Status Under Section 11(2)

In a significant development, the Delhi High Court in ZARA v. ZORA held that a formal declaration under Rule 124 of the Trade Marks Rules is not a prerequisite to invoke protection under Section 11(2) of the Trade Marks Act, 1999. The Court emphasized that the status of a mark as 'well-known' can be determined on the basis of evidence presented during litigation, without requiring prior recognition by the Trademark Registry.

Section 11(2) prohibits registration of marks that are identical or deceptively similar to a well-known mark, even if the latter is not registered in India. The judgment clarifies that Rule 124, which provides a procedural mechanism for declaring a mark as well-known, does not create an exhaustive gateway for such claims. The Court reasoned that the substantive right under Section 11(2) must prevail over procedural requirements, ensuring effective protection against dilution and free-riding.

For practitioners, this decision reinforces strategic flexibility in asserting well-known mark status. Brand owners need not wait for administrative recognition to seek protection in court. However, it also places greater evidentiary burden on plaintiffs to substantiate well-known status through consumer surveys, market share data, duration of use, and media recognition. The ruling aligns with the statutory intent of the Trade Marks Act to protect well-known marks under the Paris Convention framework.
