Delhi HC Questions Jurisdiction in IP Cases

November 4, 2026

The Delhi High Court cautioned against filing IP suits with minimal territorial nexus, warning that such practices undermine jurisdictional integrity and amount to forum shopping.

Landmark Ruling on IP Jurisdiction

In ABD Maestro Private Limited v Great Galleon Ventures Ltd, Justice Purushaindra Kumar Kaurav delivered a 246-page judgment questioning the High Court’s continued entertainment of IP suits with only trivial connections to Delhi. The ruling signals a strong stance against forum shopping, urging litigants and courts to respect jurisdictional limits under the Code of Civil Procedure.

The Court emphasized that the mere presence of a defendant’s distributor or website accessibility in Delhi does not establish a substantial cause of action. It referenced Section 20 CPC and precedent requiring a tangible and direct nexus for territorial jurisdiction, warning that loose interpretations blur the Lakshman Rekha of judicial propriety.

For IP practitioners, this decision mandates rigorous scrutiny of jurisdictional pleadings. Courts may now dismiss frivolous filings at the threshold, reducing forum manipulation in trademark and copyright litigation.
