CCPA Penalizes United Biscuits for Misleading Advertising
The Central Consumer Protection Authority (CCPA) has imposed a fine of ₹1 lakh on United Biscuits Private Limited, previously known as Pladis India Private Limited, following findings that its McVitie’s Marie Biscuits were marketed with misleading claims of being 'Wholewheat'. Investigations revealed that the biscuits contained only 19.5 percent whole wheat flour, sharply contrasted with consumer expectations.
The CCPA highlighted that the prominent usage of the term 'Wholewheat' on the packaging could mislead consumers regarding the actual composition of the biscuits. Furthermore, the product contained 52 percent refined wheat flour, raising significant concerns about consumer rights and truthful advertising practices.
This penalty from the CCPA underscores the necessity for companies to adhere strictly to advertising guidelines. It reflects the regulatory authority's commitment to protecting consumer interests and ensuring transparency in food product marketing.
Corporate lawyers should take note of the increasing scrutiny over false or misleading advertisements, which could affect branding and operational strategies across various sectors, especially those pertaining to food products.
