The Calcutta High Court has upheld the economic rights of authors over their works in a recent ruling, emphasizing the intent behind the copyright amendments of 2012.

In a notable decision, the Division Bench of the Calcutta High Court reaffirmed the economic rights of authors concerning their works, underlining the fundamental intent behind the copyright amendments implemented in 2012. This ruling reinforces the position of authors as primary beneficiaries of the copyright regime.

The court clarified that authors hold rights over their contributions, irrespective of whether their works are embedded within other mediums, such as sound recordings. Each exploitation of a sound recording requires due consideration of the authors' rights, independent of its association with other artistic expressions.

“This decision reiterates that authors must be recognized as key stakeholders in the copyright process,” the court highlighted.
