BCI Circular Imposes New Social Media Regulations for Advocates

The Bar Council of India (BCI) has released a new circular that imposes strict regulations on the use of social media by advocates. This initiative seeks to combat the dissemination of misleading legal content and promote ethical standards in legal communications.

The BCI has mandated that institutions designate Social Media Ethics Nodal Officers, and has set firm guidelines for legal content creators, including law students and advocates. These guidelines stipulate that legal professionals must disclose their qualifications, the nature of their legal practice, and any use of AI tools in their content.

The circular aims to establish accountability among legal practitioners on social media platforms, encouraging transparency to harnes public trust in the legal profession. Advocates violating these provisions may face disciplinary action from the Bar Council.

“Legal content creators...are required to explicitly declare their status, refrain from guaranteeing outcomes, and disclose the use of AI tools,” the BCI emphasized.

For legal practitioners, these enhanced regulations stress the importance of ethical compliance in digital communications. Practitioners must proactively adapt to these requirements to ensure they align with the BCI's expectations, mitigating risks associated with disciplinary actions.
